On the call of the Revolutionary Marxist Party of India, a rally was organized in Sector 17 to express its views over the HISTORICIAL AND UNPRECEDENT press conference held by four Supreme Court Judges on 12 January where they have specifically said that “Democracy in India is at stake”, It seems there is no controversy between the four Judges and the Chief Justice, but against the prevailing system. All the constitutional branches, the Legislature, Executive and Judiciary must be aware of their boundaries and limitations in accordance with the Constitution. It seems the controversy has been going on since the abrogation of collegiums as the judges in the collegiums are familiar with the performance, capacity and area of specialization of the persons to be selected and this is a better system than the National Judicial l Appointment Commission.fromed by the Union government. Consequent to abrogation of NJAC there are large number of vacancies in the judicial delivery stem and people are suffering tremendously. The second moot point has been taken that it is a well settled in the jurisprudence of the country that the Chief Justice is only the first amongst the equals –nothing more or nothing less. In the matter of the determination of the roster there are well-settled and time honored conventions guiding the Chief Justice which are not being taken care of. It has been expressed by the speakers who addressed the rally that people with grievances or victims of excesses committed by the executive feel they can knock at the door of the court in the hope for justice. There is a case to be made for judicial discipline including for judges, lawyers as also the litigants –but it would be a sad day if the citizens were to conclude that the apex court is reluctant to provide them succor against wayward executive. Thus all vacancies of the judiciary need to be filled immediately. Though frustration in the higher echelons of the judiciary appears to be consolidating into anger, still the situation is not out of hand which requires a good deal of consultation and cooperation. This incipient confrontation must not be allowed to grow as that would injurious to the public interest .and country’s democratic system. It is the duty of the government to dispel the impression that it is deliberately and indirectly giving vent to its own frustration after its plan to establish a National Judicial Appointments Commission that was thwarted by the SC. The rally was addressed by Shri Sajjan Singh, Secretary, MRPI, Inderjit Singh Grewal, Member, Central Committee, S.K.Khosla, Joginder Singh, PDS Uppal members of the state committee of the Revolutionary Marxist Party of India.
